Terms And Condition
|This agreement (“Agreement”) is between wholesale hosting service provider Netspaceindia. (“Netspaceindia.com”) at No,07, Owte Mala Nandanvan Colony. Jai Bhwani Road, Nashik Road. Nashik, Maharashtra. INDIA and the Customer or Hosting/Internet Service Reseller (“Customer”) specified in the electronic order form annexed herein by reference (“Order”). The agreement is made effective as of the date of the order.By using services (“Services”) provided by NetSpaceIndia, Customers agree to comply with the Acceptable Use Policies outlined in this agreement (AUP) and also to indemnify NetSpaceIndia against any claims arising from any violation of this Policy of the NetSpaceIndia Master Service Agreement.NetSpaceIndia reserves the right to make changes to this Acceptable Use Policy at any time without notice, and those changes will be effective immediately upon posting to NetSpaceIndia web site at: http://www.netspaceindia.com. NetSpaceIndia Customers agree to and are responsible for regularly reviewing this Policy. Continued use of NetSpaceIndia services following any changes shall constitute acceptance of those changes by Customer.
This policy recognizes the fundamental fact that no one owns or controls the Internet. NetSpaceIndia cannot monitor or control all activities of our Customers and their clients. We do not intend to actively screen, review, censor, edit or take responsibility for the activities or content of our Customers. Customers, not NetSpaceIndia, assume all responsibility relating to their Internet activities including, but not limited to:
|Activities conducted on the Internet are subject to many of the same laws and regulations applicable to the offline environment. Customers must exercise a high degree of judgment and responsibility with respect to their use of the Services, including the responsibility to comply with this Acceptable Use Policy.Customers will violate this Policy when they or their affiliates engage in any of the following activities:|
|USE OF UNPARLIAMENTARY LANGUAGE BY CUSTOMERS|
|Customers resorting to provocative and unparliamentary language or rude and disruptive behaviour stretch tolerance, cause distress and impact on morale and efficiency. This can lead to a compromise in the level of service received by other customers and is therefore untenable. Therefore, despite the acknowledged primacy that a customer in the service industry commands, we must inform you with the greatest reluctance and deepest regret that henceforth, customers found to be offensive in their interaction with us will be required to close all their relationships with us and no refund will be issue and $200 USD fine will be applied to customer and services will not be restored until.|
|Backup of Data|
|Your use of the service is purely at your sole risk. NetSpaceIndia is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on NetSpaceIndia servers, unless otherwise specified depending on the account type.|
|NetSpaceIndia products are intangible goods that are digitally delivered, we therefore have a strict no refund policy. In the event that you have purchase the wrong service by mistake or that you would like to swap services, we are happily swap your services. (swapping of service This is not applicable on dedicated server / domain names and limited to one time swap.)|
|Using the Netspaceindia network in any way that adversely affects other NetSpaceIndia Customers is strictly prohibited. This includes but is not limited to:|
|Accounts may be terminated that include content or where links are provided to content that:|
|SPAM or Unsolicited Commercial Email|
|NetSpaceIndia has a zero tolerance policy for the sending of SPAM or Unsolicited Commercial Email (UCE) over our network. NetSpaceIndia Customers cannot send SPAM or UCE and cannot host sites or information advertised in SPAM or UCE. Customers are also responsible for the actions of their clients and must take all reasonable precautions to secure their servers and sites against SPAM exploits (e.g. open email relays and insecure CGI scripts).Violating our UCE or SPAM policy will result in penalties. Upon detection or notification of a violation of our UCE policy, NetSpaceIndia will initiate an immediate investigation. During this time, outgoing mail may be suspended from the offending ip address to prevent further violations. If a client is found to be in violation of our UCE policy, NetSpaceIndia will impose penalties and/or, at its discretion, restrict or terminate the offending account and the Customer’s access to our network. Repeated or serious violations may result in the immediate termination of the account. SPAM is a very serious matter. PLEASE DO NOT SPAM. EDUCATE YOUR CLIENTS and TAKE ALL PRECAUTIONS against SPAM EXPLOITS. NetSpaceIndia reserves the right to apply a minimum $200 US per complaint investigation/resolution charge.|
|NetSpaceIndia Administrative Login and Management Software|
|To facilitate data center/network/server management, inventory and related activities, NetSpaceIndia Hosting Plans include a NetSpaceIndia administrative account and password and/or a NetSpaceIndia Support. All reasonable precautions are made by NetSpaceIndia to maintain the security of these tools and the privacy of client data. Customers cannot tamper, hinder, delete, or in anyway change the functioning of these tools. To do so intentionally or otherwise is a violation of this agreement and is grounds for the immediate suspension of a Customer’s account.|
|This Acceptable Use Policy (AUP) is not exhaustive. NetSpaceIndia has the right to refuse service to anyone at any time WITHOUT WARNING OR PRIOR NOTICE. No refunds of fees paid will be made if account termination is due to a violation of the Acceptable Use Policy as outlined above or any other reason.|
|NetSpaceIndia reserves the right to charge investigation/resolution/cleanup fees related to any AUP violation activity. Standard NetSpaceIndia investigation/resolution/cleanup fee is $400 US or more depending on circumstances. In the case of SPAM activity additional hourly fees, charged at NetSpaceIndia standard rates, may apply.|
|Shared Accounts Limits|
|Clients may not:
The use of more than 250,000 inodes on any shared account may potentially result in a warning first, and if no action is taken future suspension. Accounts found to be exceeding the 100,000 inode limit will automatically be removed from our backup system to avoid over-usage, however databases will still be backed up. Every file (a webpage, image file, email, etc.) on your account uses up 1 inode.
Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and click “Mail” -> “Default Address” -> “Set Default Address”, and then type in: :fail: No such user here.
(b) Backup Limit
Any shared account having more that 1000 tables will be removed from our weekly backup server. All data will continue to be mirrored to a secondary drive which helps protect against data loss in the event of a drive failure.
